Terms of Service

1. Acceptance of Terms

By accessing or using the FinVerified platform at finverified.ai (the "Platform"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using the Platform. These Terms apply to all visitors, users, and others who access or use the Platform.

2. Description of Service

FinVerified provides a compliance, training, and certification platform for medical payment practices, primarily targeting dental practices, dental support organisations (DSOs), and healthcare lenders. The Platform includes diagnostic tools, evidence vault management, lender network access, team training modules, and related services.

3. Account Registration

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

4. Subscription and Billing

Paid subscriptions are subject to the billing terms presented at the time of purchase. Your subscription renews automatically unless cancelled before the renewal date. Trial periods, if offered, are subject to the conditions stated at signup. Refunds are governed by our Refund & Cancellation Policy. Clinic seats and usage-based charges are described in your order form or the Platform billing section.

5. Acceptable Use

Your use of the Platform is subject to our Acceptable Use Policy, incorporated herein by reference. You agree not to use the Platform for any unlawful purpose or in any way that violates applicable federal, state, or local regulations, including HIPAA, TILA/Regulation Z, UDAAP, and applicable state lending laws.

6. Healthcare Data

Where applicable, the handling of Protected Health Information is governed by the Business Associate Agreement (BAA) incorporated into the Provider Service Agreement. FinVerified does not use patient PHI in its AI systems; all diagnostic scoring uses anonymised session tokens only.

7. Intellectual Property

The Platform and its original content, features, and functionality are owned by FinVerified, Inc. and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any portion of the Platform without our express written permission.

8. Disclaimers

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied. FinVerified does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. Compliance scores and diagnostic outputs are informational only and do not constitute legal advice.

9. Limitation of Liability

To the maximum extent permitted by law, FinVerified shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability to you for any claim arising from these Terms shall not exceed the amount paid by you to FinVerified in the twelve (12) months preceding the claim. 10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved by binding arbitration in accordance with the American Arbitration Association Commercial Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on the Platform. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
