Lender Partner Agreement

1. Purpose and Scope

This Lender Partner Agreement ("LPA") governs participation by financial institutions, finance companies, and other lending entities ("Lender Partners") in the FinVerified compliant financing network. By accessing the FinVerified lender portal or executing a Lender Enrollment, you agree to be bound by this Agreement.

FinVerified is a compliance and certification platform — not a lender, broker, or financial intermediary. FinVerified does not originate, fund, or service financing products. Lender Partners remain solely responsible for their own lending decisions, credit underwriting, regulatory compliance, and consumer disclosures.

2. Network Standards

To participate in the FinVerified network, Lender Partners must at all times:

  • Maintain all required state and federal lending licences for the jurisdictions in which they operate
  • Comply with TILA/Regulation Z, UDAAP, Equal Credit Opportunity Act (ECOA), and all applicable state consumer lending laws
  • Not offer products with APR exceeding 36% or with deferred-interest structures that are not clearly disclosed
  • Not impose prepayment penalties on patient financing products
  • Maintain current NMLS registration where required
  • Respond to FinVerified compliance monitoring requests within 10 business days
  • Maintain active cyber liability and errors & omissions insurance at minimums specified in the Lender Enrollment

3. Platform Fees

FinVerified does not charge Lender Partners platform fees. Lender Partners are never billed for network access, listing in the Processor Compliance Registry, or referrals from practice users. The FinVerified model is practice-subscription funded; Lender Partners participate at no cost.

4. Data Access and Use

Lender Partners may access practice and patient data only to the extent necessary to evaluate and service financing applications initiated by the practice through the FinVerified platform. Lender Partners must not use FinVerified platform data for marketing to practices or patients outside of a direct financing relationship, for list building, or for any purpose not expressly permitted by the applicable patient consent.

5. OFAC and Screening

FinVerified conducts OFAC and sanctions screening on Lender Partners at enrollment and on a periodic basis. A screening hold suspends the Lender Partner's active listing pending resolution. Lender Partners must notify FinVerified within 48 hours of any regulatory action, licence suspension, or material adverse change to their compliance status.

6. Suspension and Termination

FinVerified may suspend or terminate a Lender Partner's network access immediately upon: (a) material breach of this Agreement; (b) regulatory action against the Lender Partner; (c) OFAC or sanctions screening failure; (d) consumer complaint patterns indicating systemic non-compliance; or (e) failure to maintain required licences or insurance. Termination does not affect obligations under active financing agreements between the Lender Partner and patients.

7. No Endorsement

Listing in the FinVerified Processor Compliance Registry is not an endorsement, recommendation, or guarantee of a Lender Partner's products, rates, or suitability for any patient. Practices and patients are responsible for their own evaluation of financing options.
